Dr. Elist Wants to Censor Thunder’s Place

We’ve received what seems a rather generic cease and desist letter from Elliott Benjamin of Parker Mills LLP representing Dr. James Elist in relation to My Elist Implant Experience posted by txhog.

It’s sometimes hard to figure out what a lawyer is trying to say, when they are writing a letter. Very kindly, Ken White of Popehat has taken the time to write a rather eloquent summary of some of the legal points.

The letter makes several demands:

It is a conundrum. It asks us to divulge information which we don’t have and apologise for the opinions of a member.

So according to their logic, I guess I can’t post a negative review of something I bought on Amazon anonymously? Does this mean the entire Makemeheal forum, which has literally thousands of negative reviews, is operating outside the law? What about Google reviews?

We are not broadcasting any negative information over the internet. People have to visit our site to read the content. I am not a lawyer, but I think this is a valid point.

I wonder what Dr. Elist would propose as being acceptable verification to prove a user was one of his patients. Should those who write patient reports of their surgery and surgeon also post photos of the bank transaction between the two? Do social security numbers need to be involved? Perhaps a passport photo?

McFate’s comment under the article on the Popehat site almost had me rolling on the floor laughing.

(I say ‘almost’ due to my inability to prove the accuracy of my statement had I actually admitted to :rolling: )

I was sitting at my desk at work when I read that and let out a loud laugh. Got some odd looks.

I am not able to help TP, but I think that something happens when the business is in fight versus the medical ethic.

Also if in some “medical” procedure I can clearly see the business but I have a lot of difficult to see the ethic.

In the for-profit arena, this could promote your position by releasing press releases to media and have them sell products and services for you.

All you have as a product is good will amongst men, which we all value.. But you haven’t monetized.

Limit your liability and make this as public as you can and publicly humiliate this Elist bloke.

Not able to help, but I am sure they would need a subpoena to get the information they want unless you are willing to just hand it over, you do have rights regarding the release of personal information of a member of this site. Personally I would not give any information without a subpoena for the courts saying I had to, even then I would verify it with the court. Those demands also sound more like a threat letter than a legal letter from a lawyer’s office.
